Effective September 4, 2024

The nationwide ban on non-compete agreements has been struck down, but remains unlikely to be enforced in New York courts. Employers should focus on protecting their confidential information through trade secrets and non-solicitation agreements. While the FTC may still challenge non-competes, it’s important for employers to consult with legal counsel to develop effective agreements that protect their business interests within the current legal framework.
